These Terms and Conditions (Terms) apply when you visit or use huntedandco.com (Website), create an account, place an order or otherwise purchase from us.

The Website is owned and operated by Hunted + Co Sister Collective Pty Ltd (ABN 47 680 349 848), trading as Hunted + Co (Hunted + Co, we, us or our).

By using the Website or placing an order, you agree to these Terms. If you do not agree, please do not use the Website. Nothing in these Terms excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded, including your rights under the Australian Consumer Law.

1. Using our Website

You may use the Website only for lawful purposes and in accordance with these Terms.

You must not:

  • misuse, disrupt, damage or interfere with the Website or its security;

  • introduce malicious code, viruses or other harmful material;

  • attempt to gain unauthorised access to the Website, our systems or another person's account;

  • use automated tools to scrape, copy or extract Website content without our prior written permission;

  • use the Website for fraudulent, unlawful or commercially exploitative purposes; or

  • infringe our rights or the rights of another person.

We may suspend or restrict access to the Website where reasonably necessary to protect the Website, our customers or our business, or where we reasonably believe these Terms have been breached.

2. Eligibility and account information

You must be legally capable of entering into a binding contract to place an order. If you are under 18, you may use the Website only with the involvement and permission of a parent or guardian.

If you create an account or place an order, you must provide information that is accurate, current and complete. You are responsible for keeping your login details confidential and for activity carried out through your account. Please contact us promptly if you believe your account has been accessed without permission.

3. Products and availability

We take reasonable care to ensure product descriptions, images, measurements, materials and other details are accurate. Minor variations may occur, particularly in handmade, artisan, natural or small-batch products. Colours may also appear differently depending on your screen and device settings.

Product images are illustrative and props shown in photographs are not included unless stated in the product description.

All products are subject to availability. We may limit quantities where reasonably necessary, including for limited-edition or promotional items. If an item becomes unavailable after you order, we will contact you and offer an appropriate alternative where available or refund the affected item.

Nothing in this section limits your rights where a product does not match its description or otherwise fails to meet a consumer guarantee.

4. Prices and payment

Prices are displayed in the currency selected on the Website and may change from time to time. Unless stated otherwise, Australian prices include GST where applicable. Delivery charges and any other applicable costs will be shown at checkout before you place your order.

For international orders, the recipient is responsible for any customs duties, import taxes, fees or charges imposed by the destination country, unless we expressly state otherwise. These charges are not controlled by Hunted + Co.

We take reasonable care to ensure prices and product information are correct. If we discover an obvious pricing or listing error before accepting or dispatching an order, we will contact you and give you the option to purchase at the correct price or cancel the affected item for a full refund. We will not change the price of an order after it has been accepted, except with your agreement or where required by law.

Payment must be authorised at checkout using one of the payment methods offered. Third-party payment providers may apply their own terms and privacy practices.

5. Orders and acceptance

When you submit an order, you are offering to purchase the selected products on these Terms. An order confirmation acknowledges that we have received your order. A binding sale is formed when we accept the order by dispatching it or otherwise confirming acceptance.

We may decline or cancel an order before acceptance where reasonably necessary, including if:

  • a product is unavailable;

  • payment cannot be authorised;

  • the order contains an obvious error;

  • delivery is not available to the supplied address;

  • purchase limits have been exceeded; or

  • we reasonably suspect fraud, unauthorised activity, misuse or resale contrary to an expressly stated purchase restriction.

If we cancel an order after taking payment, we will refund the relevant amount to the original payment method. We will not cancel an accepted order except where permitted by law or these Terms.

Please check your delivery details before submitting an order. Contact us as soon as possible if anything is incorrect. We will try to assist, but we cannot guarantee changes once an order has entered processing or been dispatched.

6. Shipping and delivery

Shipping options, current rates, dispatch information and estimated delivery timeframes are set out in our Shipping Policy and at checkout.

Delivery timeframes are estimates rather than guarantees unless we expressly agree otherwise. Delays may occur because of postal or courier networks, customs, weather, public holidays, high-volume periods or other circumstances outside our reasonable control. We will provide reasonable assistance if an order is delayed or appears to be lost.

Risk in the products passes to you when the products are delivered to the address supplied with your order, except to the extent otherwise required by law. If you authorise a carrier to leave a parcel unattended or redirect it, responsibility for the parcel may pass in accordance with that authority, subject to your rights under applicable law.

7. Returns, refunds and consumer guarantees

Our Refund Policy explains our 14-day change-of-mind return process, eligibility requirements and exclusions. Change-of-mind returns are separate from your rights under the Australian Consumer Law.

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

Consumer guarantee rights are not limited to 14 days and may apply to sale, promotional and hygiene-sensitive items where those items are faulty, unsafe, not fit for purpose or do not match their description.

We may ask for proof of purchase and information reasonably required to assess a claim, such as photographs of the product and packaging. You do not need to return a faulty product in its original packaging to exercise your rights. Where goods have a major failure, or cannot be returned without significant cost because of their size, weight or nature, we will meet our obligations regarding return or collection costs under the Australian Consumer Law.

8. Promotions and discount codes

Promotions, competitions, giveaways, discount codes and special offers may be subject to additional terms published with the relevant offer. If those additional terms conflict with these Terms, the promotion-specific terms apply to that promotion to the extent of the conflict.

Unless stated otherwise:

  • discount codes must be applied at checkout and cannot be added retrospectively;

  • only one discount code may be used per order;

  • discounts do not apply to gift cards, delivery charges or excluded products;

  • offers are not transferable or redeemable for cash;

  • offers are valid only during the advertised period and while stocks last; and

  • returned items are refunded at the amount actually paid after discounts.

We may cancel or refuse a promotional benefit where we reasonably believe there has been fraud, misuse, duplication, a technical error or a breach of the published offer terms. This does not limit any rights you may have under the Australian Consumer Law.

For competitions and games of chance, the specific terms will state eligibility, entry requirements, key dates, prize details, draw arrangements and any applicable permit or authority information. Promotions will be conducted in accordance with applicable Australian state and territory laws.

9. Gift cards

Digital gift cards may be used to purchase eligible products through the Website, subject to any terms displayed when the gift card is purchased.

Gift cards:

  • are valid for at least three years from the date of purchase unless a lawful exception applies or a longer period is stated;

  • cannot be redeemed for cash, except where required by law;

  • cannot be used to purchase another gift card unless we expressly allow it; and

  • should be treated like cash, as we may be unable to replace a lost, stolen or unauthorisedly used gift card.

No post-purchase administration, inactivity or balance-enquiry fees apply. If the value of an order exceeds the gift card balance, the difference must be paid using another available payment method.

Gift cards provided free of charge as part of a promotion may have different conditions and expiry periods where permitted by law. Those conditions will be disclosed with the promotion.

10. Marketing communications

If you choose to subscribe, we may send you marketing emails about new arrivals, offers, gifting inspiration and Hunted + Co news. Emails are generally sent weekly, although frequency may vary around launches and promotional periods.

You can unsubscribe from marketing at any time using the unsubscribe link in an email or by contacting us. Unsubscribing from marketing will not prevent us from sending transactional or service messages relating to your orders, account or requests.

11. Reviews and content you submit

If you submit a review, photograph, comment or other content to us, you confirm that:

  • you created it or have permission to submit it;

  • it is truthful and reflects your genuine experience;

  • it does not infringe another person's rights; and

  • it is not unlawful, defamatory, discriminatory, misleading or malicious.

You retain ownership of your content. You grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, edit for formatting or length, publish and display that content in connection with Hunted + Co, including on our Website, social channels and marketing materials. Where reasonably practicable, we will attribute user-generated photographs or creative content in the manner agreed with you.

We may moderate or remove submitted content where we reasonably believe it breaches these Terms or the law. We will not suppress or alter a review merely because it is negative.

12. Intellectual property

Unless otherwise stated, the Website and its content, including text, photographs, graphics, logos, branding, layout, video and software, are owned by or licensed to Hunted + Co and protected by intellectual property laws.

You may access and use the Website for personal, non-commercial shopping purposes. You must not reproduce, adapt, distribute, publish, commercially exploit or otherwise use our content without prior written permission, except as permitted by law.

Third-party trade marks and brand names remain the property of their respective owners.

13. Third-party services and links

The Website may contain links to or integrate with third-party websites and services, including payment, review, social media and delivery providers. We do not control third-party websites and are not responsible for their content, availability or practices. Your use of a third-party service may be governed by that provider's own terms and privacy policy.

This section does not exclude any responsibility that Hunted + Co has under applicable law for services used to fulfil your order.

14. Website availability

We aim to keep the Website accurate, secure and available, but we do not guarantee uninterrupted or error-free access. We may update, maintain, suspend or modify parts of the Website where reasonably necessary.

To the extent permitted by law, we are not responsible for loss caused solely by circumstances outside our reasonable control, your device or internet connection, or your misuse of the Website. Nothing in these Terms excludes liability that cannot lawfully be excluded.

15. Liability

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right, remedy or liability that cannot lawfully be excluded, restricted or modified.

To the extent permitted by law, Hunted + Co is not liable for indirect or consequential loss that was not reasonably foreseeable when the relevant contract was formed, or for loss caused by your unlawful use, misuse or material breach of these Terms.

Where the law permits us to limit liability for a failure to comply with a guarantee, our liability is limited to the remedy or remedies permitted by law.

16. Events outside our reasonable control

We are not responsible for delay or failure to perform an obligation where it is caused by an event outside our reasonable control. This may include natural disasters, severe weather, fire, flood, industrial action, transport or postal disruption, government action, customs delays, widespread telecommunications failure or supply-chain disruption.

If such an event affects your order, we will take reasonable steps to minimise the impact and keep you informed. Your rights under the Australian Consumer Law remain unaffected.

17. Privacy

Our Privacy Policy explains how we collect, use, disclose and protect personal information. It forms part of these Terms where relevant to your use of the Website and purchases from us.

18. Changes to these Terms

We may update these Terms to reflect changes to our business, Website, practices or legal obligations. The current version and its last-updated date will be published on this page.

Changes apply from the date they are published. They will not retrospectively change the terms applying to an order already accepted, unless required by law or agreed with you. If a change materially affects an ongoing service, we will provide reasonable notice where practicable.

19. Severability and waiver

If any part of these Terms is found to be invalid, unlawful or unenforceable, that part will be read down or removed to the minimum extent necessary. The remaining Terms will continue to apply.

If we do not immediately enforce a right under these Terms, that does not mean we waive that right.

20. Governing law

These Terms are governed by the laws of New South Wales, Australia. You and Hunted + Co submit to the non-exclusive jurisdiction of the courts of New South Wales and any courts entitled to hear appeals from them.

Nothing in this section limits any rights you may have under applicable consumer laws in another Australian state, territory or jurisdiction.
